40GRID ACCEPTABLE USE POLICY
This Acceptable Use Policy (this “AUP“) is hereby incorporated by reference and made part of, the 40grid Terms of Use (the “Terms”). All capitalized terms used in this AUP that are not defined will have the same meaning as set forth elsewhere in the Terms. In addition to all applicable terms and conditions set forth elsewhere in the Terms, this AUP governs your access to and use of, and your Authorized Users’ access to and use of thePlatform. The types of activities described in this AUP are not meant to be exhaustive, but merely illustrative of examples of conduct deemed by Provider to be inappropriate, improper, illegal, or otherwise harmful to Provider’s reputation or Platform, and are therefore prohibited when using the Platform. Provider reserves the right to amend, alter, or modify the conduct requirements as set forth in this AUP at any time.
When you or your Authorized Users use the Platform, you agree not to, and you agree to cause your Authorized Users not to:
- Violate any law, rule or regulation;
- Violate, infringe, or misappropriate other people’s intellectual property, privacy, publicity, or other legal rights;
- Interfere with or disrupt the Platform or the network used to support or provide thePlatform, including any hacking or cracking into thePlatform, or attempt to circumvent any technological measure or authentication measures that we have implemented to protect the Platform;
- Use any software or program that damages, interferes with or disrupts the Platform or another’s computer or property, such as denial of service attacks, spamming, hacking, or uploading computer viruses, worms, Trojan horses, cancelbots, spyware, corrupted files and time bombs;
- Attempt to or decipher, decompile, disassemble, or reverse engineer any of the software or other underlying code used to provide the Platform;
- Engage in spidering or harvesting, or participate in the use of software, including without limitation spyware, designed to collect data from the Platform;
- Use or distribute unauthorized software programs or tools, such as “auto” software programs, “macro” software programs, “cheat utility” software program or applications, exploits, cheats, undocumented features, design errors, or any other hacking, altering software or tool;
- Upload, communicate, transmit or otherwise make available in the Platformany content that is or could reasonably be viewed as unlawful, harmful, hateful, threatening, abusive, harassing, discriminatory, defamatory, vulgar, likely to incite violence or racial or ethnic hatred, of obscene or indecent nature, invasive of another’s privacy, or any other content that is otherwise reasonably objectionable;
- Impersonate another person or falsely imply that you are a Provider employee or representative;
- Attempt to collect, obtain, or phish for a password, account information, or other information or personal data of other users;
- Improperly use technology support or make false reports to Provider;
- Use, view or otherwise evaluate the Platform so as to enable creation of competing services or products, or for benchmarking or similar competitive analysis purposes.
- Modify any file or any other part of the Platform that Provider does not specifically authorize you in writing to modify;
- Attempt to use the Platform on or through any service that is not controlled or authorized by Provider;
- Use the Platform in a country in which Provider is prohibited from offering the Platform under applicable law, such as one that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country;
- Be listed on any U.S. Government list of prohibited or restricted parties;
- Be non-compliant with applicable third-party terms when using the Platform;
- Engage in any other activity that disturbs the professional environment Platform Provider aims to provide its clients; or
- Promote or encourage any third party to participate in any prohibited activity described above.
